Practice of Law - What is Considered Unauthorized Practice of Law
For our December meeting, we would are excited to bring to you a very relevant and thought-provoking topic that is so important as an estate planner, what exactly is considered to be unauthorized practice of law?
The speakers for this program will be Rodger Lofton, an Attorney out of Paducah, KY and a member of the KY Ethics Unauthorized Practice of Law Committee, and Ashley Gillispie, Deputy Bar Counsel with the KY Bar Association in Frankfort, KY.
Mr. Lofton is a graduate of the University of Kentucky (B.A., 1976; J.D., 1979). Admitted to practice in Kentucky and in the U.S. District Court for the Western District of Kentucky since 1979, and in the Sixth Circuit Court of Appeals since 1984. Mr. Lofton has practiced in Paducah, Kentucky since 1979 and has been a solo practitioner since 1988. His practice has always been concentrated in Plaintiff’s personal injury and disability claims, and Kentucky workers’ compensation claims have always comprised a significant portion of his practice. Mr. Lofton has given presentations on Kentucky workers’ compensation law for CompEd, the McCracken County Bar Association, Western Kentucky Paralegals and at other Continuing Legal Education seminars.
Ashley Gillispie is Deputy Bar Counsel in the Office of Bar Counsel with the Kentucky Bar Association. In this capacity, she investigates and when appropriate, prosecutes violations of the Kentucky Supreme Court’s Rules of Professional Conduct. Ashley is also the Bar Counsel liaison to the KBA’s Unauthorized Practice Committee and the Attorneys’ Advertising Commission. Ashley served on the NOBC’s Standing Committee on the Future of Lawyer Regulation since 2020, and in September 2023, she was appointed chairperson. She has also served on the American Bar Association’s Standing Committee on Public Protection in the Provision of Legal Services and its subcommittee on unauthorized practice, as well as the 5.5 Working Group through the ABA Standing Committee on Ethics and Professional Responsibility. Before joining the Office of Bar Counsel, Ashley was an Assistant Fayette County Attorney in Lexington. Ashley is a graduate of the University of Kentucky and Northern Kentucky University, Chase College of Law.
A buffet lunch with be served. Lunch and networking begin at 11:30 with the meeting starting at 12:00. We will finish around 1:00. The cost of this meeting is $20 for members and $25 for guests. As a reminder, if you pre-paid for the October meeting and did not request a refund, you may apply your paid fee to this meeting, if you have not already done so.
